Damages for wrongful ex-parte injunction. Lawyer-politician Wee Choo Keong, who in April won a 14-year appeal against an ex-parte injunction wrongly obtained by MBf Holdings Bhd and MBf Finance Bhd (now known as Ambank Bhd) against him, has filed for damages amounting to RM40 million against Ambank Bhd.
Wee filed the affidavit yesterday and the court accepted it today and has fixed 23-11-07 for cross-examination, if need be. MBf Holding Bhd and Ambank must file their affidavit two weeks before 23-11-07. The case today was heard before Senior Assistant Registrar, Puan Nor Hayati.

A certain businessman personality obtained an ex-parte injunction within a day back in 1993.
ReplyDeleteJust wondering whether this late personality could also have had the clout then to influence court decisions and the appointment of judges back then.
Is history repeating itself in 2007? Deja vu? Is anyone gonna come up with a 1993 tape?

ReplyDeleteAt last after 14 years and the collapsed of MBf Finance, Wee is getting some justice from the rotten judiciary. I amsure that no amount of compensation can compensate Wee for the suffering he was subjected to by MBF/Tan Sri Loy and the judiciary under Tun Hamid Omar. Good luck to Wee an dhope that he will get justice from now on.
The man behind the case was the late Tan Sri Loy Hean Heong, who was caught visting the then Lord President (Tun Hamid Omar)Chambers. MBf was also the then sole agent for Cherokee Jeep. According to newspapers cuttings MBf also "sold" a new Cherokee Jeep to Tun Hamid Omar or his family members. Tun Hamid Omar also bought a Mercedez benz (WBD1) from the late Tan Sri Loy.
I am now told that the registration number WBD1 was used by Loy Teik Ngan, Tan Sri Loy's eldest son, who is a good friend of Kalimullah. Kalimullah has written a lot about Loy Teik Ngan in his Sunday Column in the NST.
Prior to Kalimullah appointment as the Bernama chief, he was also a director of MBf Group of Companies.
Can anyone help to throw some light on how Loy Teik Ngan was able to salvage Taylor College for his family when MBf Capital Bhd, whihc also owned MBf Finance Bhd, collapsed.
It was most unusual that Taylor College and other profitable assets of MBf Group of Companeis were allowed to be taken out from Danamodal Sdn Bhd or Danaharta Sdn Bhd. I strongly beleive that Tan Sri Nor Yacob can help in explaining this spcial Taylor College deal.
Can some help - perhaps on the promotion of jduges in the 1993 scandals of hte judiciary? It was Tan Sri Loy then in 2000 Vincent Tan, Tengku Adnan and V K Lingam according to the famous video clip.
Ex-parte? Mr Rocky is Mr Wee's case similar like Mr Jeff Ooi's case? The NST obtained ex-parter injunction against Mr Ooi for his defation suit, right?

It seemed that many people have forgotten that many personalities in the Wee Choo Keong V MBf case hav ebeen rewarded.
For a start the counsel acting for MBf and obtained the famous ex-parte injunction in 1993 was none other than the now Court of Appeal Judge, Mr Gopal Sri Ram. After he had obtained the ex-parte Injunction, he was promoted directly to Court of Appeal. This is the first time in Malaysian legal history that a lawyer was promoted directly tothe Court of Appeal without serving as the Hig Court Judge!. Sri Ram promotion was done during Tun Hamid Omar time.
According to some lawyers, in court Sri Ram is a big bully not only to young lawyers but also his fellow jduges.
Tun Ahmad Fairuz was appointed as the Election Judge to hear the Election Petition filed by Dr Lee Chong Meng against Wee. At that time Ahmad Fairuz was the High Court Judge. After Ahmad Fairuz disqualified Wee as MP on rediculous ground and instead of declaring a by-election for Bukit Bintang, he appointed the loser, Dr Lee Chong Meng, as the elected MP. This was what Ahamd Fairuz has contributed to BN.
Remember what VK Lingam said in the famous video clip, "Datuk, you have contributed to the BN in the Wee Choo Keong Election Petition case."
Soon thereafter Ahamd Fairuz did his "national service" (according to VK Lingam) for disqualifying Wee, who was elected by the voters, Ahmad Fairuz was promoted to the Court of Appeal. Ahmad Fairuz was very junior to many other High Court judges when he was rewarded to be in the Court of Appeal.

Am not disagreeing with Wee's action. In fact he deserves the justice to correct the miscarriage.

When Wee was disqualified as Bukity Bintang after the 1995, the whole world knew that it was a fixed up. When the Election Judge appointed the loser, Dr Ayam to be appointed MP it confirmed beyond doubt in the Malaysians mind that Wee's disqualifiaction was a fixed up by the Election Judge.
ReplyDeleteNow that VK Lingam had mentioned theElection Petition against Wee (in the video clip) as one of the major contributions by Tun Ahamd Fairuz to BN is confirmation beyond doubt that it was a fixed up by the judiciary with corporate figures and MCA to disqualify an elected MP.
What puzzled me and many other Malaysians is: WHEN WEE WAS DISQUALIFIED AS AN MP AND THE MCA CANDIDATE WAS APPOINTED AS THE MP FOR BUKLIT BINTANG BY A JUDGE, THE DAP DID LAUNCH ANY CAMPAIGN TO PROTEST AGAINST THIS UNDEMOCRATIC ACT OF AN THE ELECTION JUDGE OF APPOINTING A LOSING CANDIATE IN GENERAL ELECTION TO BE A MP.
Instead of campaigning against the decision of the election judge, the DAP supremo, Lim Kit Siang and gang sacked Wee from the DAP presumably to pave way for Kiot Siang's on to be the secretary-general.
I read with disgust that Lim Kit Siang and the DAP supremo are now trying to jump on the wagon to protest against the state of the judiciary based on the video clip.
The DAP could have played their nopble role as an opposition party in 1995 (when Wee was disqualified)to launch a national protest against the undemocratic act of the Election Judge and I am sure that Malaysians would have supported it as MP should be elected by hte voters.
My advise to the DAP supremo is that Malaysians are not stupid and we can see through the DAP leaders that they are not sincere and hypocrite.
DAP - where is your political credibilty? How to have credibility when its leaders are only interested in promoting their sons and daughters. To show a few obvious examples, Lim Kit Siang is still promoting his son and daughters and Karpal Singh is trying his best to promote his sons.
DAP stands for DADDY ANAK PARTY!
KEADILAN must be careful, Lim Kit Siang and gang will go all out to hijack the campaign for a clean judiciary from Parti Keadilan beczasue the DAP now realise that the scandal of the judiciary touches the hearts and minds of the nation. Therefore, Keadilan should just only allow the DAP leaders to be passengers.

I regret to state that in 1993 Wee should accept that Lim Kit Siang had no choice but to look after his son, Lim Guan Eng. Just like Badawi having to look after Khairy, who is just the son-in-law whereas Lim Guan Eng is Kit Siang's son. So it is understandable that Lim Kit Siang had promoted his son, Lim Guan Eng, ahead of everybody else including, Tan Seng Giaw.
ReplyDeleteWee would have been alright if he accepted the Kit Siang's rule that everyone in the DAP must play the second fiddle.
I still think that Wee was wrong for not accepting that "blood is thicker than water". Therefore, Wee must not expect the DAP under Lim Kit Siang will fight for his real justice because he was not even Kit Siang's son-in-law like Khairy is to Badawi.
If one were to look into DAP history one would know that any threat to Lim Guan Eng's political future will not be tolerated in the DAP.
Wee deserved to be sacked for not accepting nepotism in the DAP!

ReplyDeleteHaving read all the postings, I am convince that the DAP only know how to condemn other parties of nepotism but their no.1 practice it to the fullest. It is a case of "Cakap tak serupa bikin."
I hope Jeff Ooi and a few others that joined the DAP recently have now gone through orientation in the DAP that they must learn the art of "Kow Tow to Lim Guan Eng and Lim Kit Siang".
So Jeff Ooi must be an expert in ball carrying by now. If Jeff has yet to acquire the art of ball carrying then his days in the DAP will be numbered.
I hope that Jeff Ooi will achieve his agenda to be a Member of Parliament. To be a DAP candidate he must carry Guan Eng's ball.
DAP is an irrelevant opposition party. Lim Kit Siang only believes in taking of his son and daughter. He is interested in ensuring the DAP as LIM DYNASTY!

Other political party leaders have retired but not Lim Kit Siang, who has been there for 30 over years. Ling Liuong Sik, Lim Kheng Yaik, Tun Dr Mahathir and the others have retired. Lim Kit Siang and Karpal Singh are still holding on and passing the batons to their sons.
We must teach Lim Kit Siang and Karpal Singh that Malaysians do not support nepotism whether in government or opposition.
People like Jeff Ooi joined the DAP thinking that he will be MP over nite. Jeff Ooi and company will be just a bag carrier to Lim Guan Eng and no more. After joining the DAP, Jeff ooi will just be a party to supporting nepotism.
